Case law has established that sexual harassment is unlawful as it constitutes a detriment under the SDA. It should not be forgotten that sexual harassment can be an imprisonable criminal offence, notably under the Protection from Harassment Act 1997. Generally Sexual Harassment is accepted by tribunals and courts as being unwanted conduct of a sexual nature with the purpose or effect of violating the dignity of that person and of creating an intimidating, hostile, degrading, humiliating or offensive environment. This can include unwelcome physical, verbal or non-verbal conduct.
